Chevron fined nearly $1M for Calif. refinery fire

SAN FRANCISCO (AP) -- Chevron was fined nearly $1 million by the state on Wednesday in connection with a fire last year at the company's San Francisco Bay area refinery that sent a cloud of gas and black smoke over residential areas.

Investigators found "willful violations" in Chevron Corp.'s response before, during and after the Aug. 6 fire in Richmond caused by an old, leaky pipe in one of the facility's crude units, said Ellen Widess, chief of the California Division of Occupational Safety and Health.

"Our ... investigation showed that Chevron had repeated warnings and recommendations from its own metallurgists and pipe inspectors about the condition of this pipe," Widess said.

"Chevron was in a unique position to really know the hazards that they deal with from their dynamic technologies and processes, many of which are proprietary. They alone were in position to have addressed these hazards."

The agency filed 25 citations against oil giant, and said the $963,200 in fines were the largest allowed by state law. The company said it planned to appeal some of the violations.

Among the findings, the agency said the company didn't follow recommendations of its own inspectors and scientists made in 2002 to replace the corroded pipe that ultimately ruptured and caused the fire.

"Chevron had pervasive violations in its leak repair procedures throughout the refinery," the agency found. "Investigators identified leaks in pipes that Chevron had clamped as a temporary fix. In some cases the clamps remained in place for years, rather than replacing the pipes themselves."

Cal-OSHA also cited Chevron for not following its own emergency shutdown procedures when the leak was first spotted, and said the company exposed workers to harm by not ensuring they wore proper safety equipment when going back into the burnt out crude unit following the blaze.

No workers were seriously injured in the incident.

Eleven of the violations have been classified as "willful" because investigators found that Chevron had not taken actions to eliminate dangerous conditions for employees, including replacement of the pipe that ruptured.

The investigation also cited the company for failing to file in writing its mandated "thorough review" of a new type of pipe that it wants to use in replacement of the old one that failed.

Company spokesman Sean Comey said Chevron disagreed with some of the violations.

"Although we acknowledge that we failed to live up to our own expectations in this incident, we do not agree with several of the (Cal-OSHA) findings and its characterization of some of the alleged violations as 'willful,'" he said in an email. "Chevron intends to appeal."

Smoke and gas from the fire prompted thousands of people to seek medical treatment, with many complaining of eye irritation and breathing problems.

The fire was caused by a decades-old pipe that the company had neglected to replace, even after inspecting areas near the segment that failed less than a year earlier.

Chevron has paid $10 million in connection to nearly 24,000 claims from residents and to nearby hospitals and local government agencies in Richmond and Contra Costa County, the company said in a report filed earlier this week.

Most of that money went to the hospitals to pay for medical exams and treatments following the incident.

While the fines may not be a major deterrent for a company that earned an estimated $25 billion in 2012, the agency said industry is often more sensitive to a violations classification, such as "willful," than monetary penalties.

"There's a huge stigma to willful violations with all industries," Erika Monterroza, a Cal-OSHA spokeswoman.

Chevron's El Segundo refinery and its oilfield near Bakersfield are also under investigation by Cal-OSHA.

Peer pressure trumps 'thin' ideals in the media

Jan. 30, 2013 ? Peers exert a greater influence on teenage girls' dissatisfaction with their bodies than do thin ideals in television or social media use, according to new research by Dr. Christopher J. Ferguson and colleagues from Texas A & M International University in the U.S. Their study is published online in Springer's Journal of Youth and Adolescence.

The influence of the media on body image, life satisfaction, and symptoms of eating disorders in teenage girls is a hot debate. Some experts believe that media influences on body dissatisfaction may extend to symptoms of eating disorders. Others contend that the link between media exposure and body image is inconsistent. Ferguson and his team's work shed light on this debate, by comparing the effects of peers and the media on girls' body dissatisfaction, eating disorder symptoms, and life satisfaction in general.To assess exposure to thin ideals in the media, the researchers asked 237 young Hispanic girls, aged 10 to 17 years, to name their 3 favorite television shows and to rate the attractiveness of the female actresses in those shows.

They also assessed their body weight and height, whether or not they had feelings of inferiority in response to other girls (peer competition), and how often they used social media. The girls were then asked about how they felt about their bodies, whether they had any eating disorder symptoms, and how satisfied they were, overall, with their lives. Six months later, the researchers repeated these measures in 101 teen girls from the initial group.On the whole, neither television exposure to thin ideals nor social media use predicted body dissatisfaction, whereas peer competition did. Similarly, television exposure and social media use did not predict eating disorder symptoms.

Peer competition predicted eating disorder symptoms long-term, though not in the short term. Interestingly, both peer competition and social media use predicted lower life satisfaction.

The authors conclude, "Our results suggest that only peer competition, not television or social media use, predict negative outcomes for body image. This suggests that peer competition is more salient to body and eating issues in teenage girls. However, social media use may provide a new arena for peer competition, even if it does not directly influence negative body outcomes."

RIM rebrands as BlackBerry; launches nifty new devices

NEW YORK (Reuters) - Research In Motion Ltd on Wednesday unveiled the long-delayed line of smartphones it hopes will put it on the comeback trail, but it disappointed investors by saying U.S. sales of its all-new BlackBerry 10 devices will not start until March, sending its share price tumbling 12 percent.

Chief Executive Thorsten Heins also announced that RIM was abandoning the name it has used since its inception in 1985 to take the name of its signature product, signaling his hopes for a fresh start for the company that pioneered on-your-hip email.

"From this point forward, RIM becomes BlackBerry," Heins said at the New York launch. "It is one brand; it is one promise."

RIM, which is already starting to call itself BlackBerry, had initially planned to launch the new BlackBerry 10 devices a year ago. But it pushed the release date back twice as it struggled to perfect a new operating system.

Ahead of Wednesday's announcements, analysts had said that any launch after February would be a black mark for the Canada-based company.

"The biggest disappointment was the delay in the U.S., that it will take so long before the devices get going there," said Eric Jackson, founder and managing Partner at Ironfire Capital LLC in New York.

Heins said the delays reflected the need for U.S. carrier testing, although carrier AT&T Inc offered few clues on what that meant. Instead, the carrier merely stated it was enthusiastic about the devices and would announce availability, pricing and other information at a later date.

"Carriers in all other parts of the world get their devices through the testing process significantly faster than the U.S. carriers do," said John Jackson, an analyst at IDC, adding that the U.S. process can often take "weeks" longer.

Nevertheless investors were extremely disappointed with the delay and RIM shares on the Nasdaq ended the day 12 percent lower at $13.78. Its Toronto-listed shares fell by almost the same margin to close at C$13.86.

RIM launched its first BlackBerry back in 1999 as a way for busy executives to stay in touch with their clients and their offices, and the company quickly cornered the market for secure corporate and government emails.

But its star faded as competition rose and the BlackBerry is now a far-behind also-ran in the race for market share, with a 3.4 percent global showing in the fourth quarter - down from 20 percent three years before. Its North American market share is even smaller - a mere 2 percent in the fourth quarter.

RIM shares have tumbled along with the company's market share and the stock is down 90 percent since its 2008 peak. Despite the pullback on Wednesday, RIM's share price has more than doubled over the last four months, reflecting the growing buzz about its new devices.

TOUCH COMPETITION

The new BlackBerry 10 phones will compete with Apple's iPhone and devices using Google's Android technology, both of which have soared above the BlackBerry in a competitive market.

The BlackBerry 10 devices boast fast browsers, new features, smart cameras and - unlike previous BlackBerry models - enter the market primed with a large application library, including services such as Skype and the popular game Angry Birds.

The BlackBerry Z10 touchscreen device, in black or white, will be the first to hit the market, with a country-by-country rollout that starts in Britain on Thursday.

A Q10 model, equipped with a small "qwerty" keyboard that RIM made into its trademark, will launch globally in April.

"I'm still confident that a lot of the subscriber base are going to want the upgrade to BlackBerry 10. It's a very strong improvement over what they currently have. This is not going to cause mass defections from iOS and Android, but it doesn't have to be a success for RIM. You've got to start somewhere," said Jackson of Ironfire, which owns shares in RIM.

The Z10 device won a lukewarm review from The Wall Street Journal's tech blogger Walt Mossberg, who complained of a shortage of apps.

On the other hand, David Pogue, who writes for The New York Times, apologized for describing BlackBerry as doomed in the past. The Z10 touchscreen device was "lovely, fast and efficient, bristling with fresh, useful ideas," he said.

While technology analysts conceded that RIM has done quite a remarkable job on many of the features of BlackBerry 10 and on the array of its app selection for a new platform, many argue it will be a very tough slog for RIM to regain its crown.

"I don't think that RIM will return to its glory days," said Charles Golvin, analyst at Forrester Research. "Success for them looks like staunching the bleeding and clawing back a percentage or point or two of market share."

Announcements about pricing so far have been in line with expectations. U.S. carrier Verizon Wireless said the phone would cost $199 for a two-year contract, while Canada's Rogers Communications is quoting C$149 ($150) for certain three-year plans.

GLITZY LAUNCH

RIM picked a range of venues for its global launch parties, including Dubai's $650-a-night Armani Hotel, which occupies six floors of the Burj Khalifa, the world's tallest tower.

The New York event took place in a sprawling basketball facility on the Lower East Side of Manhattan, just north of the Manhattan Bridge. The BlackBerry has been "Re-designed. Re-engineered. Re-invented," RIM said.

RIM, which is splurging on a Super Bowl ad to promote its new phones, also introduced Grammy-winning singer-songwriter Alicia Keys as its global creative director.

"I was in a long-term relationship with BlackBerry and then I started to notice some new, kind of hotter, attractive, sexier phones at the gym, and I kind of broke up with you for something that had a little more bling," Keys said at the New York launch.

"But I always missed the way you organized my life and the way you were there for me at my job, and so I started to have two phones - I was kind of playing the field. But then ... you added a lot more features ... and now, we're exclusively dating again, and I'm very happy," she said.

Physical therapy student develops program for Girl Scouts

2:17 p.m., Jan. 29, 2013--As a Girl Scout, Jazmine Tooles participated in activities like self-defense classes and mock space shuttle missions, so it?s not surprising that she chose the organization as a way to teach young girls about the field of physical therapy.

Now a student in the University of Delaware?s doctor of physical therapy (DPT) program, Tooles and her colleagues in the class of 2013 recently hosted a workshop called ?Explore the Magic of Motion? for Girl Scouts ranging from 6th to 12th grade. ?

Legislative Fellows

UD students are working with the Delaware General Assembly as part of the Legislative Fellows Program.

Exploring the magic of motion

Jazmine Tooles, a student in UD's doctor of physical therapy program, has developed a comprehensive program to teach young women about the field of physical therapy through the Girl Scouts.

Tooles also created three Scout badges and had them approved by Girl Scouts USA last fall.

The Magic of Motion badge teaches 6th to 8th graders how to be physically active and demonstrates the role exercise plays in healing the body and maintaining health. It also invites girls to investigate professions that use exercise for healing.

The Healing through Motion badge teaches 9th and 10th graders how physical therapy improves the quality of life for many people and encourages girls to promote healthy living through exercise as physical therapists. ?

The Healing People, Changing Lives badge is a career-oriented patch that teaches 11th and 12th graders about the profession of physical therapy and the steps involved in becoming a physical therapist.?

?Jazmine did an amazing job designing these new Girl Scout badges, and she developed a great program for the 40 girls who attended the workshop,? says Laura Schmitt, associate director of clinical education in UD?s physical therapy department.

The workshop used four stations ? ?Technology that Treats,? ?Muscles and Machines,? ?Follow Your Heart,? and ?Stress Strategies? ? to teach the participants many of the principles incorporated into the badges. The scouts also toured UD?s PT Clinic, made their own stress balls, and created information cards about stress management so they could promote wellness to family and friends.

?The event stemmed from an idea sparked at an American Physical Therapy Association conference I attended in 2011,? Tooles says. ?A prominent topic was how physical therapy professionals could better promote the field and show that it entails much more than just giving massages. As we brainstormed in small groups, I reflected on the many experiences I had as a Girl Scout. That?s when I decided that creating Girl Scout badges would be a great avenue for promoting the profession to young girls and their parents.?

Tooles hopes to see the program continue at UD after she graduates in December.? Her bigger dream is for it to be shared with other physical therapy programs around the nation. ?

?I think the Girl Scouts is a great way to reach girls who are beginning to think about not only what what they want to pursue in college but also how to gain control of their own health,? Tooles says.

UD?s DPT curriculum includes a service learning requirement that comprises four categories: diversity, promoting the profession, promoting primary and secondary prevention in health and wellness, and volunteerism.

20 or 21 reported dead in Kazakhstan plane crash

ALMATY, Kazakhstan (AP) ? A passenger jet carrying at least 20 people crashed Tuesday near Kazakhstan's principal city, Almaty, killing all on board, the airline and officials said.

The SCAT airline said the plane carried 15 passengers and five crew. The Kazakh Prosecutor-General's office said 21 people were aboard.

Officials said the plane, flying in from the northern city of Kokshetau, disappeared from radar view at around 13:13 p.m. local time (0713 GMT). The airline said the pilot was making a second approach through heavy fog when the plane crashed about five kilometers (3 miles) from the airport.

The Emergencies Ministry said the plane was a Bombardier CRJ200, a two-engine regional jet that can accommodate about 50 passengers.

SCAT said the cause for the crash will not be determined until flight recorder data are examined.

The General Prosecutor's Office said it is opening a criminal investigation into the airline.

Prime Minister Serik Akhmetov ordered the creation of a state commission to investigate the crash.

This is the second major aircraft accident recently in Kazakhstan. In December, 27 people died when an An-72 military plane crashed near the southern city of Shymkent during violent snowstorms.

SCAT, which is based in Shymkent, is banned from flying within the European Union. The company operates regional flights within Kazakhstan, a country of 16.5 million people spread across an area four times the size of Texas.

Only one airline in Kazakhstan, state-owned Air Astana, is authorized to fly to the EU.

Irrigation in California's Central Valley intensifies rainfall, storms across the Southwest

Jan. 28, 2013 ? Agricultural irrigation in California's Central Valley doubles the amount of water vapor pumped into the atmosphere, ratcheting up rainfall and powerful monsoons across the interior Southwest, according to a new study by UC Irvine scientists.

Moisture on the vast farm fields evaporates, is blown over the Sierra Nevada and dumps 15 percent more than average summer rain in numerous other states. Runoff to the Colorado River increases by 28 percent, and the Four Corners region experiences a 56 percent boost in runoff. While the additional water supply can be a good thing, the transport pattern also accelerates the severity of monsoons and other potentially destructive seasonal weather events.

"If we stop irrigating in the Valley, we'll see a decrease in stream flow in the Colorado River basin," said climate hydrologist Jay Famiglietti, senior author on the paper, which will be published online Jan. 29, in the journal Geophysical Research Letters. The basin provides water for about 35 million people, including those in Los Angeles, Las Vegas and Phoenix. But the extra water vapor also accelerates normal atmospheric circulation, he said, "firing up" the annual storm cycle and drawing in more water vapor from the Gulf of Mexico as well as the Central Valley.

When the additional waves of moisture bump into developing monsoons, Famiglietti said, "it's like throwing fuel on a fire."

Famiglietti, an Earth system science professor in the School of Physical Sciences, and colleague Min-Hui Lo, a postdoctoral researcher at the University of California Center for Hydrologic Modeling who is now at National Taiwan University, painstakingly entered regional irrigation levels into global rainfall and weather models and traced the patterns.

"All percent differences in the paper are the differences between applying irrigation to the Central Valley and not applying it," Famiglietti said. "That's the point of the study -- and the beauty of using computer models. You can isolate the phenomenon that you wish to explore, in this case, irrigation versus no irrigation."

Famiglietti's team plans to increase the scope of the work to track how major human water usage elsewhere in the world affects neighboring areas too. A better understanding of irrigation's impact on the changing climate and water availability could improve resource management in parched or flooded areas.

Background checks for gun purchases up since Newtown massacre: FBI data

CHICAGO (Reuters) - Background checks for firearms purchases spiked after the December 14 mass shooting at a school in Newtown, Connecticut, new data from the FBI showed on Monday.

According to data from the Federal Bureau of Investigation's National Instant Criminal Background Check System (NICS), nine of the top 10 days for firearms checks from November 30, 1998, to January 27, 2013, including December 14, 2012, occurred since Adam Lanza killed 20 children and six adults at Sandy Hook Elementary School and then shot and killed himself.

Lanza also killed his mother before the school massacre. His use of an AR 15 assault-type rifle and high-capacity ammunition magazines have been at the heart of the contentious debate over gun control.

The NICS is a nationwide system for checking criminal records, developed by the FBI with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and local and state law enforcement agencies. The system is run by the FBI.

According to the FBI data, the leading six days for background checks before the sale of firearms occurred after December 14, 2012. The top five weeks for background checks were the week of the massacre and afterward.

Since November 30, 1998, the top day for background checks before gun sales was December 21, 2012, a week after the massacre. Checks that day numbered 177,170.

The top week since November 30, 1998, was December 17 to December 23, 2012, when 953,613 background checks were requested.

Gun control advocates argue that civilians do not need to own assault weapons and high-capacity magazines. Gun rights supporters argue that efforts to ban assault weapons are an attack on the second amendment right of the U.S. constitution, which addresses the right to bear arms.

Pregnant women should get whooping cough shot: CDC

NEW YORK (Reuters Health) - Moms-to-be should get a booster tetanus, diphtheria and pertussis (Tdap) vaccine during each pregnancy to help protect their infants from whooping cough, according to a new vaccine schedule released today by the Centers for Disease Control and Prevention (CDC).

Babies don't get their first pertussis vaccine until two months of age - and even then, they aren't fully protected until after their third shot, at six months. In the interim, they are at especially high risk of getting very sick from the bacterial disease.

During a 2010 whooping cough outbreak in California, for example, more than 9,000 cases were reported and 10 infants died.

Vaccinating pregnant women serves the dual purpose of keeping moms from contracting whooping cough and passing it to their infants as well as allowing some immune cells to pass to babies through the placenta.

"It turns out that immunity wanes pretty quickly," said Dr. H. Cody Meissner, a pediatrician from the Tufts University School of Medicine in Boston who is on the CDC's immunization committee.

"Without boosting with each pregnancy, a mother's immunity will wane and she will have much less immunity to pass on to the baby," Meissner told Reuters Health.

COCOONING

Although not part of the new immunization schedule, experts recommend immunizing a new baby's father, siblings and other caretakers. That strategy is known as cocooning.

"It's a good time to make sure that everyone who will be caring for the child is also up to date on their vaccines," said Dr. Daniel McGee, a pediatrician with Helen DeVos Children's Hospital in Grand Rapids, Michigan, who wasn't involved in the new guidelines.

"You need to make sure if grandma and grandpa are coming to visit, they're protected as well," he told Reuters Health.

Along with the new guidelines for pregnant women, updates to the CDC's vaccination schedule include a routine Tdap shot for adults age 65 and older and a pneumococcal vaccine approved for adults with immune compromising conditions like kidney failure.

Some children who are ill, such as with sickle cell disease, should get meningococcal vaccines starting at two months of age, according to the schedule. Other kids don't have to start those shots until middle school.

The influenza vaccine is still recommended annually, but will now protect against four strains of flu rather than three, said Erin Kennedy, a medical epidemiologist at the CDC.

Parents should educate themselves as best they can on recommended vaccines, researchers said.

"It's quite complicated, and it does change all the time. But it's imperative for people to stay up to date and informed about which vaccines are available," Meissner said.

"There are 16 vaccine preventable diseases that children receive immunizations against in the first 18 years of life," he added. "If vaccination rates fall, we're going to see increases in some of these diseases."

Because the immunization program has focused on children, Kennedy said some adults don't know the schedule also calls for them to get a range of vaccinations based on their age, health or where they travel.

"Adults need to be aware of the fact that there are vaccines that are recommended throughout the lifespan," she told Reuters Health. "Right now coverage is low for all of these vaccines."

Updates to the CDC's vaccination schedule were published concurrently on Monday in Pediatrics and the Annals of Internal Medicine.

Are soft drinks unfairly targeted in your opinion? Do they have a rightful place in the diet?

We firmly believe all our products have a place in an active, healthy lifestyle. Any food or beverage can fit into your life ? it?s all about how much and how often. At the end of the day, we encourage people to be as active as they can be; we encourage and promote physical activity. The higher your energy balance ? balancing the calories you take in with the calories you burn ? the healthier you?re going to be. We consume calories from many different sources. But we shouldn?t single out one food or beverage alone as the unique cause of obesity.

Please explain higher energy balance.
?Energy balance? refers to the concept of balancing calories in with calories out to maintain a healthy weight. Let?s compare two people, one who consumes 2,500 calories per day versus one who consumes only 1,500 calories. You might think the person who only eats 1,500 calories a day would look healthier because he appears thin, but that person probably is not getting all the essential nutrients he needs. At 1,500 calories, he?s probably not going to get the necessary physical activity levels, either.

On the other hand, if you?re eating a balanced diet and taking in 2,500 calories a day and are very physically active (and the activity can be moderate and not necessarily vigorous); if you?re moving and eating and you?re burning as many calories as you consume, then sure, you can enjoy any food and beverage within the Coca-Cola portfolio, including ones that are low-calorie or zero-calorie.

What has Coca-Cola done to encourage its employees to lead healthier lifestyles?
We have a great wellness facility at our Atlanta headquarters. We have signs throughout our corporate campus reminding employees to take the stairs and to park far away from the entrance. We also provide incentives ?for our employees around the country?to be physically active, including discounted gym memberships, $60-off annual medical contributions just for completing online health assessments, and we also encourage our people to measure their health stats regularly.

Personally, I have a standing desk. (Yes, I practice what I preach.) But to be healthy, you don?t need anything complicated or expensive. If you work at a desk all day, you need to get moving throughout the day and try to stand as much as you can while you?re on the computer. Simply take a walk when you get a chance during the day or take the stairs ? it?s the little things that will add up. ?

Do you think Coca-Cola is playing a part in reducing in childhood obesity?
I think we?re a part of the solution but it will take all of us ? government, business and civil society ? working together to find meaningful solutions to such a complex issue. In fact, we worked with the beverage industry to remove full-calorie soft drinks from schools in 2006 and replaced them with lower-calorie, smaller-portion beverage options.? By 2010, we reduced beverage calories delivered to schools by a dramatic 90 percent. We are also working with leaders like The National Governors Council on Physical Fitness to build fitness centers across the country that ?provide the means for people to get active. To help change the way people think about nutrition and exercise we need to work together. What I?d like to see accomplished, and what Coca-Cola is striving for in the schools, is to better develop standards of fitness and nutrition. We have testing standards in basic subjects, but we also need nutrition and fitness standards because kids who eat better, and who are more active, will thrive in school.

What are the most successful programs Coca-Cola has implemented to date to increase health awareness?
We have several programs that are contributing greatly to fostering and teaching principles of healthy lifestyles, but I?ll name two: Triple Play is a program that was launched in 2005 by the Boys & Girls Clubs of America in collaboration with the Department of Health and Human Services with support from The Coca-Cola Company to encourage kids to eat a balanced diet, become more physically active and increase their ability to engage in healthy relationships. A review of the program found that boys and girls who participated in Triple Play were more physically active and had a better understanding of nutrition than those who did not participate. The kids? self-esteem also soared.

The National Governors Council on Physical Fitness is also making a big impact. We?ve dedicated more than $5 million to provide 100 communities with new fitness centers for schools. In addition, The Coca-Cola Foundation has awarded $3.4 million in grants to support fitness and nutrition programs in the U.S. and around the world. Working with the National Foundation for Governor's Fitness Councils and the American College of Sports Medicine, Coca-Cola will place 100 new fitness centers in schools across the U.S. over the next five years. The unbranded centers will feature new fitness equipment and provide more than 5 million workouts annually; helping communities put physical activity back into schools.

You work in a male-dominated world. What was your experience like going through college and post-graduate?
For my post-graduate work, I focused on science: the theoretical and practical elements in nutrition as well as healthy lifestyle factors; toxicology; plant pathology and sustainable agriculture. Long before the days of social media, I realized the importance of networking and working in a global society. Yes, I?m the first female chief scientist at Coca-Cola. Although women are still underrepresented in science, my abilities were developed because of amazing male mentors. They looked at me as nothing but a professional who they wanted to groom. I am where I am today because of my ?STEM? foundation (science, technology, engineering and math) mentoring. We?re not going to be able to compete in terms of pioneering developments in health and science without that kind of mentoring ... I?m very passionate about that.

I do think that women are catching up, but we still need more women to go into STEM disciplines. At Wisconsin there were many women Ph.D. candidates in science-related disciplines, but that?s not always the case across the U.S. or globally. And, though more is needed, I am proud to say we have many women working at Coca-Cola throughout the company.

Antigua to Reject Intellectual Property Rights of US Companies as ...

The Caribbean nation of Antigua and Barbuda has won its case against the United States at the World Trade Organization (WTO) and is now authorized and moving forward with the granted sanction ? suspension of all American-owned intellectual property rights within the Antigua borders. This trade sanction comes as a response to the US campaign against off-shore on-line gambling. That campaign has decimated an Antiguan industry and was found to violate the US WTO trade obligations. Antigua has been negotiating with the US for the past decade on some mechanism to resolve the dispute.

In a press release, Hon. Carl Roberts High Commission from Antigua to the UK indicated the following: "For nearly a decade, Antigua has sought to resolve the dispute with the United States Government over the US failure to abide by American treaty obligations with regard to remote gaming." Colin Murdoch, Trade Ambassador for Antigua goes on: "This decision [to suspend US IP rights] did not come easily. After countless proposals from our government have been more or less ignored by the Office of the USTR - numerous decisions by the WTO declaring the United States Government's position illegal - and failure of the United States Government to provide meaningful proposals to end the dispute, the WTO provides this remedy not to encourage illicit behavior by nations; but rather to provide them with a way to secure their legal rights as sovereign nations."

At this point, the Antiguan government has not indicated the exact date when suspension will begin or whether the suspension will apply to both IP procurement and enforcement. About 10 patent applications were filed in Antigua in both 2010 and 2011.

Two American physicists outline the role played by Austrian physicist Friedrich Hasen?hrl in establishing the proportionality between the energy (E) of a quantity of matter with its mass (m) in a cavity filled with radiation. In a paper about to be published in EPJ H, Stephen Boughn from Haverford College in Pensylvannia and Tony Rothman from Princeton University in New Jersey argue how Hasen?hrl's work, for which he now receives little credit, may have contributed to the famous equation E=mc2.

According to science philosopher Thomas Kuhn, the nature of scientific progress occurs through paradigm shifts, which depend on the cultural and historical circumstances of groups of scientists. Concurring with this idea, the authors believe the notion that mass and energy should be related did not originate solely with Hasen?hrl. Nor did it suddenly emerge in 1905, when Einstein published his paper, as popular mythology would have it.

Given the lack of recognition for Hasen?hrl's contribution, the authors examined the Austrian physicist's original work on blackbody radiation in a cavity with perfectly reflective walls. This study seeks to identify the blackbody's mass changes when the cavity is moving relative to the observer.

They then explored the reason why the Austrian physicist arrived at an energy/mass correlation with the wrong factor, namely at the equation: E = (3/8) mc2. Hasen?hrl's error, they believe, stems from failing to account for the mass lost by the blackbody while radiating.

Before Hasen?hrl focused on cavity radiation, other physicists, including French mathematician Henri Poincar? and German physicist Max Abraham, showed the existence of an inertial mass associated with electromagnetic energy. In 1905, Einstein gave the correct relationship between inertial mass and electromagnetic energy, E=mc2. Nevertheless, it was not until 1911 that German physicist Max von Laue generalised it to include all forms of energy.

I installed my FTM 2010 in my new desktop computer using the disc that I received for FTM 2010. My old computer had Windows XP. My new computer has Windows 8. I had no problems installing it or the data, so I thought. When I check for updates, I am told I do not have system administrator rights; that I need to either log in as the administrator on my computer or run FTM as the administrator. I checked and I am logged in as the administrator on the computer. To check on updates, I have to right click on the desktop icon for FTM, then left click on "run as administrator". A window appears and asks me "do you want to allow this program from an unknown publisher to make changes to your computer", I then click "yes". What did I do wrong, can you help?

Waiting for LTE to roll out to your neighborhood? FCC Chairman Julius Genachowski understands, and he's trying to speed up the process. The commission's head honcho recently announced new actions to the Broadband Acceleration Initiative, clarifying technical provisions within the Middle Class Tax Relief and Job Creation Act of 2012 that should make mobile broadband deployment a little easier. The crux of the change focuses on how requests to modify existing base stations and wireless towers are reviewed, and is designed to give providers less pause when investing in building out their infrastructure.

"Just as is the case for our nation's roads and bridges, we must continue to invest in improvements to cell towers and transmission equipment, in order to ensure ubiquitous, high-speed Internet for all Americans," Genachowski said in an official statement. Actions would provide more certainty to providers and spur private investment and deployment of critical high-speed Internet equipment

(Washington, D.C.) - FCC Chairman Julius Genachowski today announced new actions as part of the Broadband Acceleration Initiative, a comprehensive effort to remove barriers to broadband build-out, including streamlining the deployment of mobile broadband infrastructure, such as towers, distributed antenna systems (DAS) and small cells.

The Commission defined and clarified a technical provision in the Middle Class Tax Relief and Job Creation Act of 2012 regarding local review of requests to modify an existing wireless tower or base station. This provision will accelerate deployment and delivery of high-speed mobile broadband to communities across the nation. This action will create greater certainty and predictability for providers that today invest more than $25 billion per year in mobile infrastructure, one of the largest U.S. sectors for private investment.

The Commission today also launched a proceeding to expedite placement of temporary cell towers - cells on wheels (COWs) and cells on light trucks (COLTs) - that are used to expand capacity during special events, such as the Inauguration or the Super Bowl.

Chairman Genachowski also announced actions in the coming months to further streamline DAS and small cell deployment; examine whether current application of the tower siting shot clock offers sufficient clarity to industry and municipalities; and begin developing model facility siting rules for localities. Each of these actions would contribute to faster, more efficient deployment of wireless infrastructure.

Chairman Genachowski said, "Providing more certainty to industry and municipalities, and more flexibility to carriers to meet extraordinary, short-term service needs will accelerate private and public investment to strengthen our nation's communications networks. Just as is the case for our nation's roads and bridges, we must continue to invest in improvements to cell towers and transmission equipment, in order to ensure ubiquitous, high-speed Internet for all Americans. Cancer is thought to arise from DNA damage at fragile sites in the genome. A study published by Cell Press on January 24th in the journal Cell reveals a new class of fragile sites that contributes to DNA alterations in a type of blood cancer called B cell lymphoma The findings could lead to the development of more effective treatments for B cell lymphoma and potentially other cancers.

"This study describes an underlying mechanism of genome instability in B cell lymphoma that could not be previously explained," says senior study author Andr? Nussenzweig of the National Cancer Institute. "The phenomena that we show in mice may be important for cancer initiation and progression in humans."

DNA damage can occur at fragile sites when DNA is replicated prior to cell division, and regions that are hard to copy, such as repetitive sequences, are especially prone to double-strand breaks. Because immune system cells called B cell lymphocytes are among the most rapidly dividing cells, they are at great risk for replication-induced DNA damage. In addition, in the nonreplicative stage of the cell cycle, B cell lymphocytes can acquire double-strand breaks through the action of an enzyme that helps build antibody genes called activation-induced cytidine deaminase (AID), which causes a lot of collateral damage in the genome, storing up problems that get exacerbated during replication. But AID activity cannot account for many mutations associated with B cell lymphoma.

In the new study, Nussenzweig and his team uncovered an AID-independent source of DNA breaks associated with replication called early replicating fragile sites (ERFSs). Applying a genome-wide sequencing approach to mouse B cell lymphocytes, they found that DNA damage occurs at ERFSs during early stages of replication. Moreover, these sites overlapped significantly with DNA alterations associated with B cell lymphoma, suggesting that ERFSs are a major feature of the mutational landscape of this type of cancer and possibly other cancers.

"Cancer is an evolving disease, and DNA damage associated with replication is one of the processes occurring in malignant cells to help them adapt and survive when a tumor metastasizes," Nussenzweig says. "Therefore, understanding how replication-induced DNA damage occurs in both healthy and cancer cells may provide a better understanding of how cancer arises and help in designing more effective treatments."

Woman sues Match.com for $10M after attack

A Las Vegas woman who was severely beaten by a man she met through Match.com is suing the online dating site for $10 million?two years and multiple surgeries after the attack that left her hospitalized for months.

The woman, Mary Kay Beckman, was stabbed multiple times with a butcher knife on Jan. 21, 2011?by?Wade Mitchell Ridley, and when?the knife broke, he stomped on her head. Ridley, who was sentenced to?28 to 70 years,?died in prison last year. He was also facing a murder charge in Arizona for the stabbing death of a former girlfriend a few weeks after the attack on Beckman.

Beckman filed suit in Clark County, Nevada,?accusing Match.com of negligence, negligent misrepresentation, deceptive trade, failure to warn and negligent infliction of emotional distress.

The site, she said, failed to warn her about the dangers of meeting "an individual whose intentions are not to find a mate, but to find victims to kill or rape."

The real estate agent said she joined Match.com about a month before her first in-person meeting with Ridley on Sept. 26, 2010. They dated for 10 days, but she called it off. That's when Ridley started sending her threatening and harassing messages.?

On Jan. 21, 2011, Ridley attacked Beckman in her garage, and left her for dead, she says, when she stopped making a "gurgling noise."?

Beckman, now 50, continues to recover and to speak out against online dating?"I do not believe that online dating is a safe venue for men or women,"?she?recently?told?a?local?FOX?TV?reporter.

Match.com, in a statement to NBC News Friday, said that what happened to Beckman "is horrible, but this lawsuit is absurd.?The many millions of people who have found love on Match.com and other online dating sites know how fulfilling it is. And while that doesn't make what happened in this case any less awful, this is about a sick, twisted individual with no prior criminal record, not an entire community of men and women looking to meet each other."

Safety, the site said, "is very important to Match," which, like many other online dating sites, includes online and offline tips for staying safe.

In California, Match.com and two other dating sites, eHarmony and Spark Networks, signed a joint statement of business principles, agreeing to screen for sex offenders and take other safety steps after a woman was assaulted on a date, the state attorney general's office said last March.?

Genes provide clues to gender disparity in human hearts

Jan. 24, 2013 ? Healthy men and women show little difference in their hearts, except for small electrocardiographic disparities. But new genetic differences found by Washington University in St. Louis researchers in hearts with disease could ultimately lead to personalized treatment of various heart ailments.

Generally, men are more susceptible to developing atrial fibrillation, an irregular, rapid heartbeat that may lead to stroke, while women are more likely to develop long-QT syndrome, a rhythm disorder that can cause rapid heartbeats and sudden cardiac death.

While prior studies have clearly established differences in the development of heart disease between men and women, very few studies had looked at the molecular mechanisms behind those differences in human hearts.

Igor Efimov, PhD, the Lucy and Stanley Lopata Distinguished Professor of Biomedical Engineering in the School of Engineering & Applied Science at Washington University in St. Louis, and a former doctoral student, Christina Ambrosi, PhD, analyzed 34 human hearts looking for genetic differences that might explain gender differences in heart disease.

The team took advantage of the unique opportunity at the university to obtain failing human hearts at the time of transplantation from Barnes-Jewish Hospital and non-failing hearts unsuitable for transplantation from Mid-America Transplant Services, a St. Louis-based organ procurement service.

The team screened for 89 major genes in electrophysiology, ion channel subunits, calcium handling proteins and transcription factors important in cardiac conduction and in the development of arrhythmia and the left atria and ventricles in human hearts.

"What was striking in this study is that we expected very large gender differences in expression of genes in the ventricles, but we did not find such differences," says Efimov, also a professor of medicine, of radiology and of cell biology and physiology at Washington University School of Medicine. "Unexpectedly, we found huge gender differences in the atria."

The results showed that women with failing hearts have a weaker system of gene expression than men -- males showed overall higher expression levels of nearly all of the 89 genes than women.

Women showed particularly lower atrial expression levels of several important genes encoding for potassium channels, including Kv4.3, KChIP2, Kv1.5 and Kir3.1. In fact, the atria of women with heart disease had less than half of the KChIP2 mRNA than atria in men.

Results of the research were published in PLOS ONE.

Efimov says while there are still many questions that need to be answered to explain these molecular differences, one factor that could be contributing to the difference is estrogen.

"When women have the highest levels of estrogen, they are least vulnerable to arrhythmia -- women are protected by estrogen," he says. "But after menopause, women develop atrial fibrillation at the same rate as men. We don't understand this and need to study this in humans."

Another potential factor is circadian rhythm, Efimov says.

"Humans are much more likely to die suddenly from heart disease early in the morning, between 5-7 a.m.," he says. "In the cardiac system in mice, it has been shown that there is an oscillation of gene expression, so certain genes expressed at 5 a.m. could be different by threefold at 5 p.m."

Efimov says the study on human hearts is unique to Washington University, as much cardiac research elsewhere is done mostly in animal models. In the future, the team would like to expand the research into pediatric hearts, taking advantage of Washington University's leading pediatric heart transplant program to learn more about pediatric physiology.

Egyptian mummy's elaborate hairstyle revealed in 3-D

Nearly 2,000 years ago, at a time when Egypt was under the control of the Roman Empire, a young woman with an elaborate hairstyle was laid to rest only yards away from a king's pyramid, researchers report.

She was 5 feet 2 inches in height, around age 20 when she died, and was buried in a decorated coffin whose face is gilded with gold. A nearby pyramid, at a site called Hawara, was built about 2 millennia before her lifetime. The location of her burial is known from archival notes. ?

High-resolution CT scans reveal that, before she was buried, her hair was dressed in an elaborate hairstyle.

"The mummy's hair is readily appreciable, with longer strands at the middle of the scalp drawn back into twists or plaits that were then wound into a tutulus, or chignon at the vertex (crown) of the head," writes a research team in a paper published recently in the journal RSNA RadioGraphics. They note that it was a popular hairstyle at the time, which may have been inspired by a Roman empress, Faustina I, who lived in the second century. [ See Photos of Egyptian Mummy's Reconstruction ]

Today, thanks to research and reconstruction work that includes high-resolution CT scans, anthropological analysis, 3-D printing and facial reconstruction drawing, this woman, along with two other mummies, are being brought back to life. Their three-dimensional faces and hair, carefully reconstructed by professional forensic artist Victoria Lywood, of John Abbott College, are set to be revealed tomorrow (Jan. 25) at the Redpath Museum at McGill University in Montreal, Canada.

In pictures sent to LiveScience the reconstructions appear vividly real in every aspect, from the tone of their muscles to the color and style of their hair. It looks like they could be people living today.

"They are three human Egyptian mummies that have been trapped in the manner they held when laid to rest nearly 2,000 years ago. And now we can reveal what they might have looked like," the team writes in a press release.? All three mummies were donated to the Redpath Museum in the 19th century.

While two scientific papers have recently been published on them, and their reconstructed faces are set to be unveiled, there are still plenty of mysteries for Egyptologists to tackle. For instance, when researchers scanned the woman they found three puncture marks, each about an eighth of an inch (3-4 millimeters) across, on the right side of her abdominal wall, wounds that may have killed her, leading to the question ? how did she get them???

"These wounds were believed to have occurred either before or shortly after death," the researchers write in their RadioGraphics paper, "although these CT findings are far from conclusive, it is possible that the punctures are related to the cause of death."

The 'matron'
Another mummy, dubbed the "white-haired matron," is of a woman who lived long enough to see her hair go gray, likely passing away sometime between the ages of 30 and 50. Radiocarbon dating indicates that she lived late in the time of Roman rule (A.D. 230-380), when Christianity was growing in Egypt and mummification was soon to go out of style. At 5 foot 3 inches, she was relatively tall for her time, and museum records indicate that she was found somewhere in the ancient Egyptian city of Thebes (modern-day Luxor).

She suffered from a problem quite common in ancient Egypt ? bad, and rather painful, teeth. "Thecondition of the teeth of (the mummy) was poor," the team writes in the RadioGraphics paper, noting that she was missing several of them and that a large cavity, between two teeth, was visible along with several abscesses.

The third reconstructed mummy lived a few centuries earlier than the other two, at a time when a dynasty of Greek kings ruled Egypt. If he and the matron could talk, they could sympathize with each other?s dental problems. [ Mummy Melodrama: 9 Secrets of Otzi the Iceman ]

The 5-foot-4-inch male mummy had numerous cavities, including one that caused a sinus infection, possibly killing him. His condition was so bad that in his final days he had a form of linen "packing," dipped in medicine, inserted into one of his cavities. According to records he also was found in Thebes, with CT scans showing that he died relatively young, likely in his 20s or early 30s.

Western University researcher Andrew Wade, a leading member of the team, said at a recent Egyptology symposium in Toronto that the development of high-resolution CT scans has played a key role in advancing the study of Egyptian mummies, including these three individuals, unveiling tiny details that help bring their past to life.?

"The high spatial and contrast resolution of the last decade of CT studies of mummies has allowed us to examine the paleo-anatomic minutiae (of mummies)," he said.
